Next Step: Busola Dakolo takes Fatoyinbo to Appeal Court

Celebrity Photographer, Busola Dakolo says she will appeal the judgment which nullified her suit against Pastor Biodun Fatoyinbo of the Commonwealth of Zion Assembly, COZA.

Justice Oathman A. Musa of the High Court, Abuja, had earlier in the day nullified Dakolo’s suit against Fatoyinbo and awarded N1 million against her, saying that the matter amounted to injustice and an abuse of judicial process, adding that the case was empty and purely sentimental.

Dakolo had accused Fatoyinbo of raping her 20 years ago when she was 16 years old in Ilorin, Kwara State.

However, Dakolo’s lawyer, Pelumi Olajengbesi, said they would appeal the judgment.

“We have received several calls after the ruling of the High Court of the Federal Capital Territory sitting at Bwari this morning seeking our view on the decision of the court, hence, this statement.

“The court ruled that the matter is statute-barred because the events that crystallised to the cause of action took place 16 years ago and that the claimant Mrs. Busola Dakolo has only six years within which to seek redress in court in line with the statute of limitation.”

Olajengbesi said his client was mindful of the decision as delivered by the court, presided over by the Hon. Justice A.O Musa and that she was equally observant of the fact that the Court omitted to address the cause of action, the subject matter of the suit in determining whether it had jurisdiction to entertain the said matter.

He added: “While we acknowledge the time of the court, we know in accordance with the Nigerian judicial system that the Court’s decision is not final as it is glaringly contestable. For all intent and purposes, having seen several sponsored misleading news reports in the media, we are duty-bound to state that the court has not and did not exonerate Biodun Fatoyinbo.

“As it stands, the substance of the matter has not received any judicial attention. Biodun Fatoyinbo, through his lawyers has only argued that the court should not allow the matter to proceed to trial because it is an event that occurred long ago and hence out of time. We shall therefore in this circumstance approach a superior court to intervene for a better appreciation, and take a more expansive view of the suit considering that the subject matter is one that is novel in our clime.

Lagos state Govt. Shutdown Yaba, Jibowu roads

The Lagos State Government says it will be closing down Yaba and Jibowu/Ogunmorin axis on the 16th and 23rd of November respectively from 8:00pm to 6:00am for the Level Cross construction of the rail tracks.

It said this was in line with the Nigerian Railway Modernization Project (Lagos-Ibadan section) with extension to Lagos Port at Apapa.

A statement from the Ministry of Transportation on Wednesday said on the 16th of November, the Jibowu axis will be closed down, while the Yaba axis of the rail will be shutdown on the 23rd of November.

“The routes will be closed at night to ensure smooth and uninterrupted flow of work on the rail tracks.

“The routes will also be used interchangeably as alternative routes for motorists to get to their various destinations so that when one axis is under construction, the other axis will be opened for motorists.

“The Lagos State Government hereby appeals to road users to bear with the government as it takes steps to create proper road infrastructure that will ultimately improve the traffic situation of the state,” the statement said.


Nigeria Air Force Training Helicopter Crashes in Enugu

A training helicopter belonging to the Nigerian Air Force (NAF) has crashed in the NAF Base in Enugu after returning from a routine training exercise.

According to NAF twitter account on Friday in Enugu, the crash occurred on Thursday after a routine training.

It said that although there were no casualties, the cause of the incident was still sketchy and unknown.

@NigAirForce twitter that was re-twitted by Air Commodore Ibikunle Daramola‏, reads; “NAF helicopter suffers mishap upon landing in Enugu.

“Helicopter has crashed on landing in Enugu after a routine flight today. Fortunately, there were no fatalities or injuries to any crew member or persons on the ground.

“@CAS_AMSadique has directed that a Board of Inquiry be constituted to determine the causes of the accident.

“@NigAirForce continues to solicit the understanding and support of the general public as it daily strives to ensure the security of Nigeria and Nigerians. Details later’’.

Efforts to get NAF officials on ground at the NAF Ground Training Command (GTC), Enugu, to speak on the incident was not successful.

Those that responded to calls, who spoke on condition of anonymity, said that it was only NAF Headquarters that can authoritatively speak on the matter.

Armed FSB officers detained Danish citizen Dennis Christensen in the southern Russian city of Oryol in May 2017, shortly after Moscow banned what it said was an extremist organisation.

“We deeply regret the conviction of Dennis Christensen — an innocent man who did not commit any real crime,” said Yaroslav Sivulskiy, a spokesman for the Jehovah’s Witnesses in Russia who was in court.

“It is sad that reading the Bible, preaching, and living a moral way of life is again a criminal offence in Russia,” he added.

Christensen, who moved to southern Russia as an adult and is married to a Russian woman, insisted in closing remarks last week that he had “never committed any criminal acts”.

“I hope that today is the day that Russia defends freedom of religion,” he told journalists as he entered the packed courtroom on Wednesday.

An AFP photographer outside the courtroom saw Christensen, 46, being led past a mass of supporters by police officers following the verdict.

The Jehovah’s Witnesses, a US-based Christian evangelical movement, will appeal the verdict within 10 days, according to a statement from the organisation’s head office.

Rights groups have condemned the trial, with Amnesty International saying it was “emblematic of the grave human rights violations” taking place in Russia.

Authorities in 2017 amended an existing anti-extremism law to mention Jehovah’s Witnesses specifically, ordering their dissolution in Russia.

Intensifying crackdown

Since then, there has been an intensifying crackdown on believers, with around 90 criminal trials now pending in dozens of regions of Russia, according to the group.

More than 20 properties belonging to the organisation or its members have been confiscated by law enforcement, its US-based office said.

The 33-year-old leader of the Jehovah’s Witness organisation in Ivanovo, a city northeast of Moscow, was arrested last week on extremism charges, Russian media reported.

The Jehovah’s Witnesses say they number more than 170,000 in Russia, a country of 144 million people where most are Orthodox Christians. Thousands more of their members have fled abroad.

Members of the group — a movement that began in the United States in the 19th century — consider modern churches to have deviated from the Bible’s true teachings.

They reject modern evolutionary theory and refuse blood transfusions.

In a report last year, Human Rights Watch accused the Russian authorities of a “sweeping campaign” of harassment and persecution against the movement.

In 2010, the European Court of Human Rights ruled that the dissolution six years earlier of the movement’s Moscow branch had violated the right to freedom of religion and association.

The powerful Russian Orthodox Church has spoken out against the group, with one church official branding it a “destructive sect”.

Pastor Biodun Fatoyinbo of COZA Wins Civil Suit Against Busola Dakolo wife of Popular Singer ” Timi Dakola

 High Court in Bwari, Abuja on Thursday dismissed the case filed by popular photographer, Busola Dakolo against Pastor Biodun Fatoyinbo of the Commonwealth of Zion Assembly (COZA), over the rape allegation.

Justice Othman A. Musa in her ruling noted that the case amounted to injustice, and an abuse of judicial process as the case was empty and purely sentimental, adding that the case was aimed more at cruelty than obtaining justice.

The court also awarded costs of N1,000,000 against Busola Dakolo and held that the fine should have been 10 times more because the court’s time was wasted.

Countering Dakolo’s claims,  Fatoyinbo filed an objection and an affidavit stating that Busola’s statements were false and concocted to embarrass, scandalise and ridicule him.
Fatoyinbo claimed that from the inception, Dakolo had sought the attention of the media and press, and brought the civil action even while the Police’s investigation was ongoing.

It would be recalled that Dakolo filed the suit against Fatoyinbo over the  claim that the COZA pastor raped her 20 years ago when she was 16 years in Ilorin, Kwara State.

An allegation that had been denied by Fatoyinbo on several occasions, making him to take a break from the pulpit and later assumed ministration
