Kanu is facing terrorism-related charges as ordered by the Supreme Court, which set aside the Appeal Court verdict discharging him last year.

The trial judge, Justice Murtala-Nyako, struck out eight out of the 15 counts after ruling on the preliminary objection filed by counsel to Kanu challenging the legality of the charges. The IPOB leader had challenged the decision of the trial court to uphold seven out of the 15 counts, as his preliminary objection had sought the outright dismissal of the entire charge.

The court of appeals had dismissed the charges against Kanu on grounds that the Federal Government erred by extraordinarily extraditing him to Nigeria.   The Supreme Court had, on 15 December 2023, ordered a continuation of Mr. Kanu’s trial on terrorism charges at the Federal High Court in Abuja.
